GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITE “DISCOVERVALLIDILANZO.IT”

INTRODUCTION

This document sets out the General Terms and Conditions of Use (hereinafter the “Terms”) of the website corresponding to the domain name discovervallidilanzo.it (hereinafter the “Website”).

The owner of the Website is the Lanzo, Ceronda and Casternone Valleys Mountain Union, with registered office at Fraz. Fé 2, 10070 Ceres (TO), Italy, VAT No. 11510010017, Tax Code 92049610014, Tel.: +39 0123 53716, Email: segreteria@unionemontanavlcc.it, Certified Email (PEC): unionemontana.vlcc.to@legalmail.it (hereinafter the “Mountain Union”).

The Mountain Union has entrusted the management of the Website to the Lanzo Valleys Tourist Operators Consortium, with registered office at Fraz. Fé 2, 10070 Ceres (TO), Italy, VAT No. IT08207460018, Tax Code 08207460018, Tel.: +39 389 83 79 177, Email: segreteria@turismovallidilanzo.it, Certified Email (PEC): consorzio.operatorituristicivallidilanzo@pec.it (hereinafter the “Manager”).

The Website is not the Mountain Union’s institutional website, but a portal dedicated to tourism promotion and services for the Lanzo, Ceronda, and Casternone Valleys area.

  1. General Terms and Conditions of Use

1.1) Any person wishing to browse the pages of the Website (hereinafter the “User”) acknowledges that access to and/or use of the Website and the services it offers are subject to full acceptance of these Terms. Visitors who do not wish to accept are advised not to use the Website or download any material from it. Additional terms and conditions, in addition to those set out here, may apply to the provision of certain services or the use of other parts of the Website.

1.2) Connecting to, using, and/or browsing the Website shall constitute full and unconditional acceptance of these Terms by the User.

1.3) The User declares that they have the legal capacity required to use the Website and accept these Terms, and to assume any liability arising from or connected with the use of the Website.

2. Website Content and Services – Disclaimer

2.1) The Website is intended to provide a general information service relating to the activities of the Mountain Union, as well as information about activities, experiences, events, products, and services offered by tourism operators, both public and private, operating in the Lanzo, Ceronda and Casternone Valleys area.

Specifically, at the date of publication of these Terms, the services available on the Website are:

– Tourism information about the area

– Promotion of local events and activities

– Information on accommodation in the area

– Downloading and viewing of content

– Informational newsletter

2.2) The information on the Website is regularly checked and updated by the Manager; however, its content, at the time it is viewed by the User, may not be exhaustive, complete, or up to date and must therefore never be regarded as such by the User. The User acknowledges and accepts that neither the Mountain Union nor the Manager offers any guarantee as to the exhaustiveness, completeness, or currency of the Website, and they cannot be held liable for omissions, inaccuracies, or lack of updates in the content published on the Website. It is the User’s responsibility to independently verify the accuracy of such information.

2.3) The information, photographs, and illustrations appearing on the Website reflect the characteristics and specifications of places, services, and/or offers at the time of their publication online and are intended solely to provide a general indication of the places and/or services offered by tourism operators. Such information, photographs, and illustrations shall in no way be regarded as an offer to the public within the meaning of Article 1336 of the Italian Civil Code in respect of the products and/or services described therein, nor shall they be deemed binding for any negotiation or commercial relationship.

2.4) Detailed information regarding the types, characteristics, and conditions of services presented on the Website by tourism operators is provided directly by those operators, who are therefore solely responsible for all information displayed, including any prices and availability. Users are advised to contact the tourism operator that published or otherwise made the content available, to whom any booking request may also be directed using the contact details provided on the relevant pages of the Website.

2.5) For detailed and/or up-to-date information regarding itineraries and/or hikes, including their characteristics, accessibility, and conditions, as well as weather conditions, Users are advised to consult the bulletins issued by the relevant regional authorities (ARPA) or to write to info@discovervallidilanzo.it.

2.6) The User acknowledges that the information and/or GPX tracks available on the Website relating to itineraries and hikes are to be considered purely indicative, intended to make the User aware of the existence of a particular place and/or itinerary and its general layout, and that they refer to the most recent site survey, meaning they may no longer accurately represent the actual state of the terrain at a later date. Such information and tracks are to be regarded as the product of amateur, non-exhaustive work, and are in no way intended to replace official maps or clearly identified and signposted paths and routes. Once on a trail, Users are advised to follow its natural course and, where present, the relevant waymarking (e.g. CAI waymarking).

2.7) Trail difficulty ratings are assigned in accordance with the “Classification of routes by difficulty for hiking and mountain biking” (approved by CAI – Club Alpino Italiano, Central Committee Resolution No. 89 of 20 November 2021).

2.8) The Mountain Union accepts no liability for any harm suffered by Users who choose to undertake itineraries indicated on the Website. Users undertake such itineraries entirely at their own risk, bearing in mind that these are predominantly mountain routes and as such are subject to sudden changes caused, for example, by erosion, landslides, or subsidence, as well as to the hazards and risks inherent in such routes, including those related to weather and climate.

2.9) Services are provided by the Mountain Union free of charge (unless otherwise specified by specific conditions), on an “as is and as available” basis at the time of use.

2.10) The Mountain Union reserves the right, at its sole discretion, to discontinue the provision of the above services, to introduce new ones, or to modify the manner in which they are provided.

3. User Obligations

3.1) The User undertakes to use the Website and its Content diligently. In particular, by way of example and without limitation, the User undertakes to refrain from:

– any improper use of the Website that is contrary to law, these General Terms and Conditions of Use, and all other conditions and notices published on the Website, or contrary to public morality and good conduct

– taking any action that could prejudice the rights and interests of the Mountain Union, the Manager and/or third parties, including intellectual or industrial property rights, or that could damage, impair, or in any way prevent the normal use of the Website, computer systems or documents, files and any class of content stored therein

– reproducing, copying, transforming, distributing, making available or otherwise disclosing to other websites or to the public at large any material and/or information contained on the Website, unless such action has been expressly authorised by the Mountain Union or is carried out in accordance with Clause 6 below

– sending, distributing, or otherwise publishing, in any spaces enabled for that purpose, content that is defamatory, libellous, obscene, pornographic, abusive, sexist, racist, discriminatory, or unlawful in any way, including using the Website and its services for the purposes of fraud or phishing (used to obtain account and password information from the User)

– sending, disseminating, or distributing by any means content containing commercial or promotional offers of any kind, without the prior written authorisation of the Mountain Union.

3.2) The User undertakes not to publish any confidential information or information that could personally identify them or third parties, for example, by disclosing personal data, passwords, usernames, telephone numbers, or email addresses.

3.3) The User shall be solely liable for any damage arising from a breach of the provisions of these Terms and undertakes to indemnify and hold harmless the Mountain Union and/or the Manager from any damage, loss, liability or cost (including legal costs relating to any actions brought by third parties against them) arising from or resulting from such breach, in particular those resulting in an infringement of personality rights, intellectual and/or industrial property rights, public order, public morality, or the criminal law provisions of applicable national and/or international law.

4. Newsletter Service

4.1) The newsletter service is free of charge and can be activated by any User simply by entering their name, surname, and email address in the registration form on the Website and subsequently confirming their consent and the accuracy of their email address via the automated message sent by the system (double opt-in).

4.2) The newsletter will contain tourism information (e.g. itineraries, places to visit, events, festivals, exhibitions, etc.) relating to the Lanzo, Ceronda and Casternone Valleys area and, in general, any other information relating to the tourism offering in the area.

4.3) There is no fixed schedule for sending the newsletter; this is determined by the Manager based on events being planned and the material available.

4.4) The User may stop receiving the newsletter at any time (opt-out) by using the unsubscribe function included in each email sent, or by making a request to the Manager. For further information, please refer to the Website’s Privacy Policy, available HERE.

5. Linking and Framing

5.1) Linking to the Website is subject to the prior authorisation of the Mountain Union, which authorises linking subject to the following conditions and clarifications:

Any party wishing to include a link on their own web pages must notify the Manager in advance by sending an email to info@discovervallidilanzo.it, stating: their name or business name; their place of residence or registered office; an email address; the web address of the site on which the link is to be placed; the topics covered by and purpose of the site. Any changes involving the removal of the link, a substantial structural change to the content and purpose of the site, or a substantial structural change to the content and purpose of the page on which the link was authorised must also be communicated in advance to the same email address info@discovervallidilanzo.it.

Linking to the Website is authorised subject to the following conditions:

– the link must be made in such a way that the connection to this Website is direct and leads to the home page only

– the link must not use any trademark, distinctive sign, protected name or logo of the Mountain Union and/or the Manager, except those authorised with written consent

– the link must not in any way create confusion, even for the most inexperienced user, regarding the ownership and qualities of the owner of the site containing the link and/or the Website owned by the Mountain Union

– the link must not in any way create confusion, even for the most inexperienced user, between the activities carried out by the party placing the link and those of the Mountain Union

– where a contractual relationship exists or has existed between the party placing the link and the Mountain Union, the party placing the link must also comply with all provisions contained in the contract.

The above conditions must be met at all times from the moment the link is placed. In fulfilling the above obligations, the owner of the site creating the link must exercise the utmost diligence. The Mountain Union reserves the right to revoke this authorisation at any time. Deep linking and framing are prohibited in all cases. In any event, creating a link to the Website constitutes full acceptance of the provisions of this clause.

6. Intellectual and Industrial Property

6.1) All content published on or otherwise made available through the Website, including but not limited to: text, articles, photographs, drawings, animated sequences, audio or video recordings, icon buttons, graphics and tables, graphic representations, the architecture of the Website itself, as well as trademarks, logos and other distinctive signs (including the Website’s domain name), are the property of the Mountain Union and/or their lawful owners and licensees who have authorised their use by the Mountain Union, in accordance with applicable national and international legislation.

6.2) Software of any kind used on the Website and/or for its operation is protected by copyright, and its use without the prior written agreement of the owner and holder of exclusive rights of use is prohibited.

6.3) The name “Unione Montana” and its associated logo are registered trademarks belonging to the Mountain Union, which confer on it the exclusive right to use them both nationally and internationally in all countries in which they are registered.

6.4) Unless otherwise agreed in writing, the content of the Website and the information referred to in Article 2 above are subject to the Creative Commons “CC BY-NC 4.0” licence. It is therefore permitted to freely reproduce, distribute, transmit, and adapt the content of the Website for NON-commercial purposes, provided that the source is always cited.

6.5) Except as set out above, no part of the Website may be reproduced or stored on any other website or included in any information storage and retrieval or service provision system without the prior consent of the Administrator.

6.6) The content of the Website may not be used to create, develop, or enrich databases of any kind, whether accessible exclusively by the creator or made available to third parties.

6.7) The content of the Website may not be used for the training of generative artificial intelligence systems, nor may automated data scraping tools be used.

6.8) Any material sent by the User in connection with the Website’s services (including but not limited to comments, reports, opinions, reviews, participation in surveys and initiatives, and the submission of images or audio/video files) shall be deemed non-confidential. The Mountain Union assumes no liability of any kind in relation to such material and may use it without restriction. In particular, the User grants the Mountain Union an unlimited, free, non-exclusive right of use over such material, without limitation as to geographical area or medium. The Mountain Union may therefore, directly or through trusted third parties, use, copy, transmit, extract, publish, distribute, publicly perform, disseminate, create derivative works from, host, index, store, annotate, encode, modify and adapt (including without limitation the right to adapt for transmission by any means of communication) in any form or by any means currently known or hereafter invented, any image and any message, including audio and video, that may be sent by the User, including through third parties.

6.9) Material submitted will not be returned and will remain the property of the Mountain Union, which is therefore exempt from any liability to participants for the loss or destruction of material submitted.

6.10) Where Users submit material in order to use the Website’s services, they warrant that such material is suitable for publication and accept and undertake to indemnify and hold harmless the Mountain Union, in accordance with Article 3.3 above.

6.11) Any breach of the provisions of this article, in the absence of explicit written authorisation, will be pursued before the competent civil and criminal courts.

7. Warranties and Liability

7.1) The Mountain Union does not guarantee continuity of access, nor the correct display, download, or use of the elements and information contained on the pages of the Website, which may be prevented, hindered, or interrupted by factors or circumstances beyond its control.

7.2) In no event shall the Mountain Union be held liable for any direct or indirect damage caused by the use of the Website, the inability or impossibility to access it, reliance on the information it contains, and/or its actual use.

7.3) The information contained on the Website may be modified or updated without notice. The Mountain Union may also improve, change, or remove certain sections of the Website without notice.

7.4) The Mountain Union reserves the right to close, suspend, or discontinue unilaterally at any time and without notice the provision of services or the Website in general. The User acknowledges that the Mountain Union may not be held liable in any way towards users or third parties for the suspension or interruption of its services or the temporary or permanent removal of content.

7.5) The Website may contain links to third-party websites. Such hyperlinks are intended solely to facilitate the User’s navigation and do not imply any relationship between the content of the Website and that of the third-party site accessed, which remains outside the Mountain Union’s sphere of responsibility. The existence of links to other sites does not imply that the Mountain Union sponsors or is affiliated with the entities providing the services described on those sites. The User acknowledges that the Mountain Union may not under any circumstances be held liable for the information, content, products, and services offered or provided through the Website by third parties or entities, including those to which the Website has activated a link, or for any other content, information, or material contrary to applicable law on the linked third-party resource. Anyone who visits a site linked from the Website does so at their own risk and is responsible for taking all necessary measures and precautions against viruses or other harmful elements.

7.6) The User acknowledges and accepts that any contractual or non-contractual relationship that may be entered into with third parties contacted through the Website shall concern the User and the third party exclusively. Accordingly, the User accepts that the Mountain Union shall bear no liability for any damage of any kind in connection with negotiations, discussions, and/or contractual obligations with third parties contacted through the Website.

7.7) Under no circumstances may the Mountain Union or the Manager be held liable for damage caused to third parties as a result of the erroneous, harmful, and/or unauthorised use of material contained on the Website, or the transmission of any viruses that may infect the computer equipment of Website visitors.

8. Personal Data

8.1) With regard to the processing of data of Users who visit the Website or who request services accessible electronically from the addresses specified in point 1.2 above, the Mountain Union confirms that such data will be processed in accordance with the law, using the methods described in the Privacy Notice prepared pursuant to Article 13 of EU Regulation 2016/679 of 27 April 2016 (GDPR), and for purposes relating to the correct provision of the services requested, without prejudice to any broader consent given by the user. 9. Cookies

9.1) A “cookie” (a small data file that some websites may send to the visitor’s address while being browsed) may be found on the Mountain Union’s Website for the purpose of tracking the visitor’s navigation of the Website. The cookie is transferred to the User’s local storage device for the purpose of recording which areas of a website have been visited. This allows for faster navigation of the Website.

10. Changes to the Terms of Use of the Website

10.1) The Mountain Union reserves the right to make unilateral changes to these General Terms at any time, as published on the Website.

10.2) The User is required to check the General Terms and Conditions of Use in force periodically. Changes shall take effect from the moment they are published on the Website. Continued use of the Website by the User following a change shall be deemed acceptance of such changes.

11. Reporting Errors on the Website or Problems on Itineraries

11.1) Should any errors, inaccuracies, or malfunctions be found on the Website, reports may be sent to the following email address: info@discovervallidilanzo.it. The Mountain Union will endeavour to correct them as soon as possible.

11.2) Should any problems be found on itineraries listed on the Website (e.g. inaccessible sections, potential hazards, or other issues), the User may report them to the following email address: info@discovervallidilanzo.it. The Mountain Union will take action as soon as possible to inform the relevant authorities.

12. Governing Law and Jurisdiction

12.1) Without prejudice to any applicable mandatory provisions (for example those protecting consumers), the performance and interpretation of these Terms shall be governed by Italian law, and the Court of Ivrea (Italy) shall have exclusive jurisdiction and competence over any disputes connected with these Terms, with express waiver of any other forum that may be alternative or competent under applicable law. Notwithstanding the above, the Mountain Union and/or the Manager reserve the right, where they consider it necessary, to bring proceedings before courts in countries or cities other than Italy or Ivrea in order to protect their interests and enforce their rights.
